Recent years have witnessed a rehabilitation of early German Romanticism in philosophy, including a renewed interest in Romantic ethics. Friedrich Schlegel (1772–1829) is acknowledged as a key figure in this movement. While significant work has been done on some aspects of his thought, his views on ethics have been surprisingly overlooked. This essay aims to redress this shortcoming in the literature by examining the core themes of Schlegel’s ethics during the early phase of his career (1793–1801). I argue that (...) Schlegel’s position stands out against both the dominant Kantianism of his era, as well as against some of fellow Romantics. I show how Schlegel anticipates contemporary philosophers such as Bernard Williams, Harry Frankfurt, John McDowell, and Stanley Cavell in both his criticisms of traditional moral theory and in his attempts to develop a positive position. Immanuel Kant’s political philosophy has enjoyed renewed attention as an egalitarian alternative to contemporary inequality since it seems to uncompromisingly reassert the primacy of the state over the economy, enabling it to defend the modern welfare state against encroaching neoliberal markets. However, I argue that, when understood as a free-standing approach to politics, Kant’s doctrine of right shares essential features with the prevailing theories that legitimate really existing economic inequality. Like Friedrich Hayek and Milton Friedman, Kant understands the state’s (...) function as essentially coercive and, in justifying state coercion, he adopts a narrow conception of political freedom that formally preserves the right to choose while denying that the range of choices one actually has can be a matter of justice. As a result, Kant cannot identify various forms of social pressure as potential injustices even as he recognizes their power to create and sustain troubling inequalities. For both Kant and the neoliberals, the result is that economic relations almost never count as unjust forms of coercion, no matter how unequal they are. Views that identify coercion as the trigger for duties of justice are thus particularly ill-suited to orient us to contemporary inequality. (shrink)

At the same time as the modern idea of the state was taking shape, Hugo Grotius , Thomas Hobbes and Samuel Pufendorf formulated three distinctive foundational approaches to international order and law beyond the state. They differed in their views of obligation in the state of nature , in the extent to which they regarded these sovereign states as analogous to individuals in the state of nature, and in the effects they attributed to commerce as a driver of sociability and (...) of norm-structured interactions not dependent on an overarching state. Each built on shared Roman and sixteenth-century foundations . Section II argues: 1) that Grotius's natural law was not simply an anti-skeptical construction based on self-preservation , but continued a Roman legal tradition; 2) that Hobbes's account of natural law beyond the state was essentially prudential, not moral ; and 3) that commerce as a driver of social and moral order had a substantial and under-appreciated impact on international legal order. Each contributed to the thought of later writers such as Emer de Vattel , David Hume , and Adam Smith , and eventually to the empirical legal methodologies of Jeremy Bentham and Georg Friedrich von Martens. This chapter discusses that Friedrich Schleiermacher and Wilhelm Dilthey are united by a shared conviction that historical reality is the proper domain of philosophical inquiry. In their view, Kant's critical philosophy had effectively foreclosed the traditional enterprise of metaphysics. Rather than viewing this as a loss, however, both Schleiermacher and Dilthey took the Kantian revolution as a cue to make historical reality, as opposed to an ahistorical domain of transcendent entities, an independent field of investigation. The chapter articulates their (...) basic philosophical orientation and its enduring significance by examining two domains about which they thought deeply: philosophy of religion and ethics. In the case of Dilthey, whose work is less well known in Anglophone philosophy, the chapter also frames the discussion with an examination of his more general intellectual project, which he labeled the “Critique of Historical Reason”. This essay addresses the theoretical foundations of Danto’s vision of performance art. In his writings, Danto rarely mentions this art form and when he does so, it is for the most part in a negative way. Still, there is one clue to Danto’s deeper engagement with performance art. This is his constant references to Nietzsche’s The Birth of Tragedy. Danto finds in Nietzsche a critical tool for engaging with contemporary artists: what he calls the “Euripidean dilemma”. In this essay, I treat of a type of moral objection to Christian theism that is formulated by Friedrich Nietzsche. In an effort to provoke a negative moral‐aesthetic response to the conception of God underlying the Christian tradition, with the ultimate aim of recommending his own allegedly ‘healthier’ ideals, Nietzsche presents a number of distinct but related considerations. In particular, he claims that the traditional theological interpretation of the crucifixion of Jesus expresses the tasteless, vulgar, and morally objectionable character (...) of God, thus rendering Him unworthy of belief. In response to Nietzsche's worries, I first of all argue that his account of the origins of the belief in God is both prima facie implausible and historically false. At the same time I recognize that Nietzsche is expressing, in his typically bombastic manner, a genuine and widely held worry about what the crucifixion, as an event in salvation history, says about the nature of God. In response to this worry, I draw on the work of Wilhelm Dilthey in order to support the contention that the concept of divine transcendence, which underlies Nietzsche's concern, has its proper place within the Greek metaphysical tradition, rather than in Christian faith. Building on the work of Franz Rosenzweig and Jürgen Moltmann, I outline a conception of God that more accurately reflects the claim that the cross is the definitive revelation of the divine nature while at the same time foreclosing on the possibility of the kind of response that Nietzsche articulates. Alexander Nehamas and others have recently attempted to revive a conception of ethics that is centered on self-formation and the values of aesthetic coherence. This conception faces several difficulties, including the lack of fit between models of aesthetic coherence in literary works and individual lives and an absence of determinate content. The argument of this paper is that both of these defects are absent from the work of one of the earliest and most vocal exponents of this conception of ethics, (...) Friedrich von Hardenberg (1772–1801), better known by his pseudonym “Novalis”. The paper begins by reviewing the growing consensus among scholars that Novalis makes a serious contribution to philosophy, and by pointing out the lack of attention paid to his moral philosophy. His conception of moral life as an infinite process of approximation the archetypal unity of the divine is then explicated in detail. Particular attention is paid to the manner in which his model of moral life and conception of aesthetic coherence avoids some of the difficulties faced by more recent theorists. (shrink)

RedekopScholarly interest in the emergence of a “public sphere” and “public opinion” in eighteenth-century Europe remains strong, and with good reason. The ideological construct of a modern public in Europe “was a characteristic product of the Enlightenment, and it marked one of the critical zones of intersection between Enlightenment discourse and a broad range of socio-economic and (...) institutional changes.” 1 Analysis of the emerging figure of “the public” helps illuminate the relationship between intellectual and material culture, between “Enlightenment” and society. The recognition of the constitutive nature of language and its role in the interplay between “meaning” and “experience” 2 lead one to take seriously terms like “the public” and “public opinion” as important links between linguistic and social domains. Text and context merge into one as social entities like “the public” become rhetorical ones, and vice-versa.Keith Baker, for example, resolves the contextual dimension of “public opinion” in France into the textual one, whereby it emerges as a “rhetorical figure” or “political invention” in the latter decades of the eighteenth century. 3 Others stay closer to the social domain, including the salons of Paris, to look for the emergence of the notion of rational public opinion. 4 Taken together, these are two sides of the same coin—an emerging sphere of “public” discourse carried on by “private” individuals, and a more private sphere in which public discursivity was nurtured. 5 [End Page 81]In this article I explore these themes in a German context, focusing on the writings of Thomas Abbt (1738–66) as an attempt to grapple with the exigencies of German social and intellectual life in a novel fashion. Making use of a variety of European sourc es, Abbt—an academic with broad interests—strove in On Dying for the Fatherland (1761), On Merit (1765), and in his contributions to the seminal journal Letters Concerning the Newest Literature to conceptualize and to create a sense of citizenship and the “common good” which cut across the various divisions of German society, uniting all orders into a greater and harmonious whole or Publikum (public). The written word was the primary vehicle available for this simultaneous mo vement of enlightenment and socio-political formation, and Abbt’s works represent an early attempt to inscribe a public sphere—to create a space in which it became possible for individuals to think, talk, and act in reference to a larger socio-political whole. While Prussian patriotism was behind his initial foray into the topic of the public sphere in On Dying for the Fatherland, Abbt’s On Merit reveals an expansion in perspective, and with it the emergence of “the public” as a moral and s ocio-political point of reference. There is a good degree of continuity, however, between the two works, concerned as they are with overcoming the basic German problem of a fragmented public sphere with enlightened arguments designed to lead readers to lo cate themselves and their well-being in an enlarged societal frame.While at least one commentator has argued that Abbt was seeking to write for the common German Volk, 6 his primary audience was clearly that of the middling and higher orders. 7 The general problem Abbt addressed, however, was that of reconciling Enlightenment and reform with the entire spectrum of German society. This entailed the exploration of new, informal, and inclusive terms and modes of address: an available term was “the public,” and the mode of address a writing style which transformed ancient forms of public oratory into text—the public speaker became, under modern circumstances, the public writer.It is in this sense that Abbt was original and influential. This paper pursues the way the terms exhaustion and inexhaustibility play a central role in Werner Hamacher’s critical encounter with philosophy. The argument is developed via an engagement with aspects of Hamacher’s interpretation of Friedrich Schlegel’s Fragments. The limitations of Hamacher’s own position become an opening. What is opened up is the possibility of philosophy having become exhausted as a result of its identification with calculation and instrumentality.

Die von beiden Denkern entworfenen Theorien der Ausnahme, die aus Einsamkeit ihre vitalen Konturen beziehen, lassen sich strukturell verschranken und ermoglichen den systematischen Vergleich. Es kristallisiert sich eine nihilistische Moralkritik heraus, welcher Sachverhalt zuletzt an der Kritik einer auf Mitleid basierenden Moralphilosophie durchexerziert wird.

Ausgehend von der Grundüberzeugung Wagners, daß das dramatische Kunstwerk erst in der sinnlichen Mitteilung an alle Sinne seine vollständige und endgültige Gestalt erlange und sich daher nur im Theater verwirkliche, erweist sich die Aura-Metapher Walter Benjamins, die "einmalige Erscheinung einer Ferne, so nah sie sein mag", als treffendes Sinnbild für die künstlerische Absicht Wagners. Hatte Benjamin den "Verfall der Aura" als Symptom des Kunstwerks "im Zeitalter seiner technischen Reproduzierbarkeit" diagnostiziert, so begriff auch bereits Wagners Kritik die als kulturelle und (...) künstlerische Degenerationsform empfundene zeitgenössische Oper als Ausdruck für den allgemeinen Verfall der Kunst im Verlust ihrer ehemaligen Bedeutung und Dignität im Zeitalter eines blinden Materialismus. Wagner entwickelt seinen Kunstbegriff dagegen auf der geistigen Grundlage des deutschen Idealismus der klassisch-romantischen Epoche. Daher erscheint es zulässig, Wagner ästhetikgeschichtlich zwischen die zwei großen idealistischen Denkrichtungen, die Romantik und die Frankfurter Schule einzureihen und den ästhetischen Komplex des 'Musikdramas' von diesen beiden Polen aus zu beleuchten. Wagner setzt sein Kunstwerk und dessen theoretische Untermauerung als Versuch einer 'Reauratisierung', als Restituierung seiner Aura, ihrem Verfall entgegen. Bühnenfestspiel und Bühnenweihfestspiel als Verbindung von elitärer splendid isolation und demokratischem Kunstideal treten dabei in Beziehung zu kultischen und religiösen Wirkungsabsichten, wodurch im Rahmen der Regenerationsthese ein aus der Ästhetik gewonnener, rezeptionsgeschichtlich jedoch prekärer kulturtheoretischer Ansatz in Reichweite rückt. This chapter offers a proceduralist argument against capital punishment. More specifically, it contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. At stake is a principle of political morality: legal institutions must strive to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the morally required compensation, execution is impermissible. Along with defending (...) his key premises, Yost explains the complicated role that sentencing uncertainty plays in the argument. I Kinds of Time The following remarks concern the question of time in Walter Benjamin's thought on ethics and justice. This theme is intimately connected to his attempt to locate the idea of human action beyond the confines of the subject conceived as the underlying instance to which the will is attributed. His thought in this area is exploratory. In Benjamin's discussions and correspondence with Gershom Scholem, he experiments with ideas deriving from Jewish thought in order to create (...) a locus for his understanding of the ways in which the human being is inserted into the order of justice. It is not prejudicial to the seriousness of this attempt if one notes that this is also partly what was at work in Benjamin's relation to the ideas espoused by Brecht and Adorno. Yet it is above all in the thought broached in the discussions and correspondence with Scholem, in the years preceding the publication of the article “Zur Kritik der Gewalt” in 1921, that Benjamin takes the major steps in his meditation on justice as an order of being. In his essays “Zwei Gedichte von Friedrich Hölderlin” and “Über die Sprache des Menschen und über Sprache überhaupt” of 1914 and 1916 respectively, Benjamin works out the main features of the displacement of the centre of the literary work of art and of language from the subject to the world, to essences, and, in the latter case, to God. In fragments and essays following these first major formulations of his thought, he develops the views on justice that were to find a radical expression in his text “Zur Kritik der Gewalt”. It is not fortuitous that in one of these fragments, “Zur Bedeutung der Zeit in der moralischen Welt”, which probably dates from 1920/21, he employs the image of the storm to evoke the working of God's forgiveness in history. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Capital punishment—the legally authorized killing of a criminal offender by an agent of the state for the commission of a crime—stands in special need of moral justification. This is because execution is a particularly severe punishment. Execution is different in kind from monetary and custodial penalties in an obvious way: execution causes the death of an offender. While fines and incarceration set back some of one’s interests, death eliminates the possibility of setting and pursuing ends. While fines and incarceration narrow (...) one’s routes to happiness, death eliminates its possibility. Not surprisingly, there is much debate about the moral permissibility of capital punishment. This entry maps the terrain of this debate. The first section discusses justifications of the death penalty as they appear in major theories of punishment. The second section surveys moral objections to execution that apply to most justifications. Sometimes, you also believe that you believe P. Such self‐beliefs can also be commissive in a sense, as when they are reflective endorsements of your lower‐order commissive beliefs. In this paper I argue that one's commissive self‐beliefs ontologically constitute one's lower‐order commissive beliefs because one's commissive self‐beliefs instantiate (...) the same inferential dispositions that are constitutive of one's lower‐order commissive beliefs. Constitutive relations between commissive self‐beliefs and first‐order commissive beliefs are maximally epistemically secure because they do not result from any epistemic procedure by which one must try (and possibly fail) to detect one's first‐order commissive beliefs. This maximal epistemic security suffices to warrant one's commissive self‐beliefs, such that one possesses commissive self‐knowledge of an especially privileged sort. (shrink)

Kant famously insists that free will is a condition of morality. The difficulty of providing a demonstration of freedom has left him vulnerable to devastating criticism: critics charge that Kant's post-Groundwork justification of morality amounts to a dogmatic assertion of morality's authority. My paper rebuts this objection, showing that Kant offers a cogent demonstration of freedom. My central claim is that the demonstration must be understood in practical rather than theoretical terms. A practical demonstration of x works by bringing x (...) into existence, and what the demonstration of freedom brings into existence is a moral will, a will regulated by the moral law and capable of acting in accordance with it. Since to act morally is to act freely, bringing a moral will into existence actualizes our capacity for freedom and demonstrates that we possess it. To confirm the viability of such a demonstration, Kant must establish that agents can regulate their wills by practical principles, and that practical judgments are efficacious of themselves (i.e., that non-Humean motivational internalism is true). Entering the park like a second Theseus following his Ariadne along the thread of erotic sensations, he discovered therein (...) the myth-realm of the ancient gods as transfigured in the bourgeois decorations of the Second Reich, most visibly so in the aristocratic monuments of Friedrich Wilhelm and Queen Louise: “They towered up from their round pedestals among the flower beds as if spellbound by magic curves that a watercourse had inscribed before them in the sand.” 1 As he invoked these primal visions thirty years later, Benjamin realized that they prefigured “the features of what is to come,” that is, he recognized in his early experiential impressions the topical concerns that were to determine his life and works. He then understood that he had been finding signs of “the return of the ancient gods” everywhere:Under their sign the Old West of Berlin was transformed into the West of antiquity, whence the western winds come to the mariners, who navigate their boat with the Hesperidan apples slowly upward the Landwehrkanal, in order to cast anchor near the Herkules Bridge. Ausgehend von Walter Benjamins Idee einer romantischen Kunstkritik, die ihr Objekt im Moment seiner Kritik verfolkommnet, versucht dieser Beitrag zu demonstrieren, dass Schlegels und Nietzsches Wende von einer auf Praxis bezogenen zu einer fundamental-theoretische orientierten Philologie mit der Formulierung eines Verständnisses der griechischen Kultur verbunden ist, das diese als kritisches Instrument für eine Transformation der gegenwärtigen Kultur anwenden will. SummaryIn his doctoral dissertation—The Concept of Criticism in German Romanticism, finished in 1919 and published as a book in 1920—Walter Benjamin explores the epistemological and aesthetic foundations of the concept of criticism expounded by the early German Romantics Friedrich Schlegel and Novalis. Many of the themes in the dissertation recur in his later work, which has led scholars to believe that much of Benjamin's thought is directly influenced by the Romantics. However, a detailed investigation of the origins (...) and development of the dissertation reveals that the picture is much more complicated. Reading the dissertation alongside the biographical material now available, this article argues that the major themes which preoccupy Benjamin in The Concept of Criticism in German Romanticism, including his theories of language and knowledge as well as his messianic philosophy of history, in fact predate his study of the Romantics. As well as being a potential entry ticket to an academic career, the dissertation constitutes Benjamin's first sustained attempt to develop and consolidate his own epistemology and aesthetics in a more or less systematic way. He does so through a series of ‘judicious interpretations’ of the Romantics, whose work he reads selectively, anachronistically and creatively to provide a vehicle for his own thought. (shrink)
